As one who has been the recipient of the wrath by some of the members of this thread, I was amazed to read the recent comments by several of these very same posters. Not only is there not a scintilla of regret expressed for the immature actions for which Terje is being accused, but the very same characteristics of arrogance, name calling and even tacit implied threats, which has become the Hallmark of this CYRX thread, obviously continues to go on unabated. I therefore must conclude that many of the contributors here are missing the statement of principle that Paul apparantly is attempting to make by his going forward with his law suit. It is obvious to me that what Paul is saying in this legal action is, why should anyone who posts on a Public Forum have to worry that their post may bring retribution by an alienated reader? People are assumed to be responsible for their actions, and even on SI individuals they do not have the right to do harm to another person.
Perhaps many of you are aware that over the last year I have advocated and asked SI contributors to provide their real name, e-mail address, and fill out SI Profiles. As a strong believer in public forums, I have thought that this was just common courtesy, showed respect to the reader and elevated the overall quality of Bulletin Boards, by providing this information. However, when I read that one of the SI members, in what I consider to be a thoughtless and immature act, used this information for their own destructive purposes, I feel threatened. I ask myself therefore how many others in the future will not fill out profile forms, or supply their e-mail address, if acts like sending 25,000 e-mails, goes unpunished?
Some of you may think that the act that Terje is accused of has only minor consequences. I beg to differ. Know that I often have NOT posted on the CYRX thread because I just did not want to subject myself to the "crap" that one must be willing to put up with to express a contrary view on this thread. Now I, as I am sure Paul does, believe that we have something of value to say which just might benefit others. So you tell me what the value of the information that never got posted here, was worth? Ask deedle if he feared getting 25,000 e-mails, or that some other harmful act would be visited upon him when he posted his contrary CYRX views? Perhaps that might explain why he doesn't post his real name? Right Fuchi?
As for the damages of $25,000, I think they are realistic. Unfortunately though, it will be Terje that will have to bare the entire cost. However in my opinion, it is many of you here who share partial guilt for the act which led to Paul being swamped with e-mails. Consider the recent post, "If I knew the trick, I would do the same thing to mr. e when he was so sick to bite everyone on Cyrix and AMD threads. Terje must be hurt by mr. e much worse than we could image at that time."
What actual damages did Paul suffer you ask? Well consider the possibility that at the same time Paul was receiving his 25,000 e-mails, I, as I often do, was been trying to send Paul an e-mail alerting him, or recommending to him, certain investment decisions. And while I do not know this to be the case on September 23, it could easily have been. We all have become dependent on a functioning and reliable computer.(perhaps Intel owners a little more than M-1 users, but that's another story) (ggg). But as investors who reliant on real time information, we can not afford to have incoming e-mails disrupted during a trading day.
As an aside, you should all know that I recently purchased CYRX Calls based partially on Paul's inputs to this thread. In fact I posted this fact on this thread on Dec. 11. That's the same Paul E. that many of you have accused of being like "the antiChrist of CYRX".
It is my hope that many of you who read this response will reflect on the constructive vien in which it is written. It is my desire that we approach 1997 with an atmoshere condusive to more constructive dialoue. Therefore, I wish us all a successful and properous New Year. Jules |
