I wouldn't go that far. Many, many companies are alot of talk, but settle either before a lawsuit is filed or on the courthouse steps. As of right now, both the Q and Ericy et al. are all talk in regards to their IPR.

Let's face it, going to court is going to be extremely expensive for the Q and whoever it sues. In litigation, every hour is billable and all parties want the best legal talent money can buy.
