I'm a little rusty with Takings law & other constitutional limitations imposed upon govt in the area of siezure & regulate of private property for the public use. Moreover, I am not at all familiar with anti-trust law. Neverthess, I am piqued by your comments.

If the gov't can "taketh away," (& I don't dispute this, obviously) is there any argument for "just compensation" in order that ILEC's receive some remedy for their investment, or is their entire investment really funded by rate-payers, we, the local customers? What rights do ILECs really have w/respect to the local loop?

Notwithstanding the legal arguments, I concur that the "legal sword" will be the "motivation" of the ILECs to open up the gates of the CO.
