Res ipsa loquitur is a good characterization. Kurlak was negligent, and the result of his negligence is obvious. I think his recent improved behavior should be reinforced rather than punished. It never does any good to yell at a dog. He was lucky to have made a mess on the rug in the quarter when his masters went berserk and broke up the place. MER stockholders are going to be so busy thrashing the CEO and any other executives left around the place that they won't have time to kick the dog.
