Actually, I completely disagree with your post. The ETSI has asked the Q to license. I expect the Q not to. Why should they? What has the ETSI given to the Q? Nothing. However, Ericsson alledges that they have the IP. No one knows the extent of the coverage of Ericsson's patents, no one will know unless it goes to court and we see the outcome.
I'm willing to let you build it, but I want a reasonable return for letting you use my property. AND take a portion of my house. Remember, it really isn't about royalties, but convergence of the standard.

True, but the use is limited. Remember, CDMA2000 will not be sold in Europe and parts of Asia.
