That is how the short is being created. Fidelity is not requiring the short sellers to make good delivery of the shares. Even though they will show up on every ones statements, Fidelity does not have the shares. Fidelity will charge the shorter anywhere from 1-5 cents per month for this non deliver.

We cut the Canadian over hang down to 394,879 shares from 470,700 the week before. DLJ finally decided to start taking delivery of shares again. Merrill Lynch acknowledged no changes and Dean Witter's position was up 2290 shares. Scottsdale showed no change.
