I do not know if you have any recourse. I know that a broker has a right to call in a short position. I know that most brokers will call you and give you notice. I do not know if there is an SEC regulation or Exchange rule that requires them to do so. I know that it is plainly bad business that they did not notify you.

I defunded my Datek account recently. I looked at the thread today because Datek had many problems today, and there were a lot of people who were unable to execute orders because of it. It looks like Datek has gone from being a good execution system to a terrible one. When you couple that with their notoriously lousy customer service, I am glad that I left.
