Here's the Likely Legal Scenario:

Jackson rules against Microsoft. It is Microsoft, therefore, that appeals. If MSFT wins at the appellate level, the lower courts will have shown themselves to be divided on the case, and the Supreme Court is more likely, not less likely, to take it up.

If the government wins again in appellate court, then MSFT appeals yet again, this time to the Supreme Court. And the Supreme Court, by virtue of the importance of the case, is likely to agree to hear it.

The political circus associated with the case will not induce the Supreme Court to turn away from it. (Consider Roe v. Wade.)
