I've been following the short-share discussion, as I was unable to find shares to borrow at my brokers.

Two theories regarding Datek's buy-ins and reported proliferation of "NS" markings:

(1) Datek customers have so heavily shorted so many stocks that Datek really has no shares to lend on these issues;

(2) Datek never had all those shares to lend, putting it in the same league as every other broker on earth. They said they did, got caught short (literally), and have instituted more controls on what can be borrowed.
