With all due respect, I think you miss the point. The FCC is currently considering whether cable companies should be classified as common carriers in order to allow ISPs to access their plant. Your focus on AOL was on the content side. That's not where the battle is brewing. AOL is, obviously, also an access provider. They would like to be able to access cable plant WITHOUT partnering with @Home or anyone else.

This issue is being discussed as a result of the AT&T/TCI deal. The thinking is that designating cable companies common carriers may mitigate any anti trust concerns raised by the deal.

Obviously if this came to pass, it would not be good for @Home. Personally I think it's unlikely, but the FCC can be very unpredictable and have a habit of implementing foolish rules and regulations. This needs to be monitored carefully.
