Nick,

Looks like Diamond has hired itself a lobbyist. In the interests of full disclosure, two things should be pointed out:

1.) Michael Robertson is not a reporter. He runs a web site in support of the MP3 format which includes, among other things, CD-rippers that are commonly used to make MP3 files containing pirated material.

2.) Mr. Burger is a lobbyist for what was known as the Computer and Business Equipment Manufacturers Association in 1992.

Any "insight" Mr. Burger provides on behalf of his lobby is of necessity slanted towards association members. Representatives of CEMA and RIAA were at the table as well when AHRA was being crafted. Given the degree to which Diamond and RIAA disagreed in their press releases regarding the restraining order, I do not doubt that their respective lobbying groups will disagree on the intent of the AHRA legislation to the same degree.

Almost feel like taking a vacation to see this play out in court... :)
