If you remember, the 110 degree slot was put up for auction in the first place because the slot holder failed to meet due diligence requirements to construct a satellite. The original slot was held by Advanced, who sought to sell it to Tempo to allow Primestar to use it for high power DBS.

Here's the original FCC statement in the Advanced Matter:

Notice that the commission in their statement says that the International Bureau gave clear warning of the consequences should Advanced not meet their due diligence requirements. The same could be said of today's warning.

The question: who does Murdoch partner with?

- DIRECTV? unlikely...
- DISH it's possible he may trade the slot to DISH, should News be looking for a way to settle the $5b breach of contract suit...
- PRIMESTAR? only if the cable companies blink...

The only thing that's certain is that it would be impossible for Murdoch to go it alone and become a 4th competitor.

ps. you could argue that the original forfeiture was caused to thwart Primestar's high-power aspirations and this new one will too...
