It will be easier for ASkyB to get an extension than it was for Advanced, which had no money or hopes of actually launching a satellite. Dan Garner just wanted to sell the slot and keep the proceeds. The regulators said screw that -- we'll sell the slot and keep the proceeds.
You're right that there is some time pressure, but mostly for business reasons. All I'm saying is don't bet the ranch on all this being resolved by year's end because of this due diligence milestone. I can guarantee you that Rupert and Co. have more influence at the FCC than Dan Garner did. Advanced had absolutely nothing to show when its deadline expired. Rupert and MCI have 2 Loral satellites and enough lawsuits, broken promises, and press clipings to show what they've been doing.
Remember, what the FCC wants is for somebody to provide service. Is there another party out there who can step into News/MCI's shoes today? I don't think so. The FCC has little choice but to let these guys work out another arrangement, if they can, then see whether the new deal should be approved. Enforcing the milestone would not help the FCC reach its goal of promoting DBS competition, in my opinion.
