I have contacted SEC and NASDAQ representatives over my concern that Asensio has been able to trash BTIM and others carte blanche while hiding his own vested interest in the price moves that he is able to induce by his rhetoric. I was at least somewhat pleased that there was a weak disclaimer that accompanied the last release whereas no previous statement had any at all.

I still believe that any public statement made by any person or firm through any form of media should include, at the top and for all to see, the exact position held at the time that statement is made. I think that if Asensio's claims were read in light of a short position of somewhere around 200k shares then the reader would exercise some healthy cynicism.

On the bright side, BTIM closed up a point from its daily low and until 7 is broken I think we may be just fine in the long run. Frankly, I am hoping that another 100-150k shares went short today. That would be the rough equivalent of going long on wrong side of a head and shoulders reversal. My hopes at least.
