If I understand you correctly, apparently JAWZ has a patent pending. Speaking as an attorney with more than a passing knowledge of US patent law, patent pending status and a buck will get you a cup of coffee. I could file a patent application for a left handed screwdriver and the USPTO would accept my application. I might or might not be able to successfully prosecute that application and get the patent to issue with meaningful and commercially viable claims.

What concerned me about the JAWZ PR was their potentially 'misleading' wording:

"JAWS Technologies Announces - L5 Data Encryption Algorithm Patent is Accepted"

To the uninitiated it would be easy to assume that "patent was accepted" meant that the patent was ISSUED. A very different matter. JAWZ PR left out a critical word - the "patent APPICATION was accepted".

I don't know if this was intentional or unintentional. I do know that if I bought JAWZ on the assumption that a patent had actually issued, I might be more than a little miffed. And if any of you reading this did buy JAWZ today, don't bother PMing me to ask about suing. I've got better things to do with my time - like fishing...

I don't own JAWZ but have lurked since April waiting for an entry point. I think I'll wait a bit longer. I also have no opinion at all about JAWZ prospects RE their patent application or what an issued patent might mean for their technology. It can't hurt, but it sure can take a long time and be a money pit.

And yes there are a few advantages to being able to market your product as 'patent pending'.
