A boilerplate NDA is written by lawyers to prevent one of the parties from revealing trade secrets to their competitors. Breaking an NDA usually does not result in a lawsuit because it is always difficult to prove that Party A breached the NDA, but it probably results in the loss of trust/confidence in the prospective vendor/partner who signed it and loss of any future business. Also word gets around the industry that Vendor A cannot be trusted with trade secrets or to honor legal agreements. An OEM might want to enforce the NDA because they have plans to launch a new product at a certain date/event ( eg Comdex or Interop, etc..)and they do not want their competitors to learn about it until they officially launch via press release,etc..

PS - I find it interesting that the person who previously went by the alias Adam Rapport/Wilhu obviously had links to either Brocade or Vixel( there is someone who works at Vixel named Will Hu and Vixel also sells the "Rapport" hub..hmmmm..) Obviously whoever was feeding this person information had questionable scruples/business ethics..Perhaps we'll never know if someone at Brocade( or ex-brocade ) was really behind the Ancor "dirty tricks" campaign. I also find it interesting that nobody has been posting the latest Brocade OEM wins either here or on Yahoo ( eg.."Bullstroke"..debatable whether that was the same"adam/ar/wilhu" who posted on SI )
