Right. Fight. They would. ATT will not be denied its manifest destiny. How is it fair that ATHM goes through all this work and suffering just to be destroyed by government? Fair isn't what its cracked up to be especially when facing well-established legal precedent. I will be doing DD on this by investigating telephone/telegraph similarities. My knowledge and experience has been that there is no way government will get away with some level playing field end around. That would be discriminatory and punitive.

It isn't only that ATHM's contracts run out, it is also that other competitors, like TWX-Road Runner, have created an effective competitive market. The RBOCs need to get into fiber distribution to compete, so they can set up the same relation with AOL or MSOs that ATT and TCI would like to create. If the common carrier approach is pursued by government, there is a lessened incentive to create that alternative big scale competitive network.

You are also implying that contract sunset eliminates concern over restraint of trade issues associated with exclusivity clauses. I believe that exclusivity invites government interference regardless of contract exhaustion.
