Nice to have some company on this issue. My point has always been that this issue is political not legal or technical. There are many examples of the government sacrificing fairness for the sake of political expediency. Trying to use telcom examples to support this argument, I've cited must-carry and digital TV. Here's another: How about the losing bidders in the C-Band PCS auction? How fairly do they think they've been treated when the winners defaulted on their license payments, and the FCC, for purely political reasons, decided to change the payment schedule? Ahhaha can present the legal precedents going all the way back to the telegraph, but it doesn't matter. The only precedent that counts is that the govt. will do whatever it thinks it can get away with in an attempt to cater to the lowest common denominator. In this case that's probably Gene Kimmelman.
