I don't know whether this is MSFT's defense strategy. I think what MSFT wants to show is this type of proposals/words are common in this industry. You could interpret this as "divide market" as a weapon to sue others, but you could interpret as "cooperation" as well. It is up to the Judge to determinate how to interpret it.

I just read a document from a link in other MSFT vs NSCP thread. You could pick some words and interpret it as bad intention. But if you looked at the whole document, they could be interpreted as an cooperation effort too.
