VERDICT IN ON MOTIONS AGAINST AOL
Alright BNEZers, here is the scoop, as you know I have been calling the court house for the last 5 weeks checking up on our motion for discovery against AOL.
BIG TIME NEWS.
At 2:30 PM this afternoon the following ruling came out.
1. Motion for Summary Judgement is denied for AOL, ( YESSSS )
2. BNEZ is granted LIMITED DISCOVERY
"" The Court concludes that discovery into the issue of whether AOL alters or manipulates stock information as opposed to receipt and republication is a relevant issue." The discovery granted relates to the entire issue of data transmission and whether that conforms to case law that opens AOL up as a " Content Provider ".
All of this is a landmark decision, because for the first time the Communications Decency Act, ( thats where they put the language not holding service providers liable ) has failed to protect AOL.
BNERers, this is ONE BIG FRIGGIN CRACK IN AOL EGG, looks like it is time to break it wide open and get even now.
I bet this will be on business channels and everything on Monday.
Remember, this language covered all providers, ie, Yahoo, SI, AOL, you name it, they had the law to cover them, not now.
I'm so happy to see that the judge decided we had a real case and had the big Kuhunas to stand up for the little guy, WELL for all of us wanting publicity on BNEZ, I'm sure we are going to start to get it very very soon.
GO BNEZ
