The testomany from David Colburn only showed to the court that
back in 1996 , AOL saw the NSCP as a real threat to AOL's business with NSCP
owning more than 90% of the browser business , and is ready to enter into AOL's internet service business with its Netcenter , and Monopoly in the browser market.
It is hard proof i.e Colburn saw NSCP as a big threat to AOL from his own memo.
That is why AOL came to NSCP for a deal under the following conditions

1) NSCP promised not to get into AOL's business in three years.
and
2) NSCP agreed to let AOL has a seat in NSCP's board so that AOL can be sure that
NSCP wil fulfill its promise of 1)

or
1) NSCP gave its NSCP to AOL, and let AOL have a control so that AOL can make sure NSCP will not get into the INTERNET SERVICE business.

NSCP did not agree any of the above, so AOL went to Microsoft and promise Microsoft that AOL will help to promote Microsoft's IE if Microsoft will put AOL's
icon in win95 which will let AOL have a parity if MSFT later decided to get into the
Internet service too. By helping Microsof promoting IE, AOL will break NSCP's
monopoly position in Browser market , which will also reduce the chance of NSCP
entering the internet service business, or at least delay it. So, AOL is really use MSFT to kill NSCP, or break NSCP monopoly position in browser.

As to Colburn claimed that the reason MSFT got AOL's contract is because MSFT will put AOL's icon into win95, that is just pure lie thinking about that AOL already
had 13 millions of customers at that time and with the help of ALL hardware OEM vendors. Colburn really tried to hide its real intention in the testomany, so he was lying , and we all knew that based on hard proof provided by AOL itself !!!
