It was directed towards me. I don't specialize in the subtleties of applicability of legal precedent to contemporary business practices. These issues are too complex even for legal departments with 100 lawyers. Indeed, this issue may be Supreme Court decision precedent setting and I suspect that will happen with a terrifically bullish outcome for all telecommunications companies and all ISPs. It is manifest destiny.

Deadline was last Thursday.

We can never know that the merger can move forward sans FCC rulings. FCC makes final decision about allowing it or not. It is assumed that the merger will be allowed with concessions. So far, the concessions requested have not been acceptable in light of Armstrong's comments today. The earliest possible merger completion date would be 3/31/99. It is unlikely that will occur since it would require the other side to basically capitulate. Capitulation isn't an option given the stakes which are literally the future of communications, MOT vaporware notwithstanding.
