I believe it will be very difficult to prove a case, but good luck. The company warned about visibility in both the 2nd and 3rd quarter press releases. Here is an excerpt from the 3rd quarter: " The Company is facing stiff competition from other companies trying to establish their cards, SSFDC (Solid State Floppy Disk Card) and the Miniature Card, as the industry standard for small form factor storage devices. Harari said: "Order visibility weakened during this latest quarter. SanDisk's OEM customers in these emerging markets are still having difficulty gauging the initial market demand for their new products. "
