Drink and drive is a crime, drink and drive and hit people on the street is definitely a crime. But drink did not necessarily lead to drive or drive and hit people on the street. The problem for DOJ in this case is DOJ always comes to the conclusion that
if people drink will drive afetr , or if a people drink will drive and will hit people on the street. So, from DOJ's point of view, if you drink then you commit a crime, because DOJ thinks if you drink you will always drive and hit people on the street. But , what if I drink and then go to bed to sleep ? Is it a crime , too ?

So , from DOJ's logic, if company says anything that it will protect its market , especially for companies which have a dominate position of certain products in the market, is a crime. Because DOJ automatically came to the conclusion that that company is to misuse its what so called monopoly power to protect its market.
What if a company try to protect its market by developing a better products than its competitors ? Is this a crime ? Microsoft integrate IE into win95/98 to make win95/98 a better product to protect its OS market is counted as a crime by DOJ !!!
