Jonathan - I don't understand your point, unless it is just to let companies get away with murder and not make them accountable for their actions. You're saying, "look, you can't expect to get much out of this, so just let it slide." I'd go after this company under these circumstances if my reward at the end was one red cent.

Second, if most situations like this one are settled out of court, why should the stock take a hit if/when a lawsuit is announced? Doesn't everyone know it'll be settled out of court, as you said? In any event, it's a sure bet that if I don't file, someone else will.

Lastly, I *had* an investment in this company. I sold on the bad news (at 11 1/2 - a great move with the stock now at 9 1/8). I also took almost every one of my clients out at about the same price. There's no reason to be there, as I've said numerous times before. So now I don't care if the stock goes to zero, as long as they've got enough money to pay the judgment I plan to have against them.

This company helped the short-sellers enough on its own - the shorts didn't need my help. They got all the help they could have wanted before I decided to try to do something about it.
