I think you're splitting hairs. things apple could do to hurt sun would potentially benefit apple as well as msft. Neither Apple nor MSFT have a significant share of the primary markets SUN plays in, so it seems like a stretch to see this as an abuse of monopoly power. It is hard to see how Office97 is an 'essential facility' either. But since this is one of the DOJ issues I guess we'll see how it plays out.
