This TRO seems to prevent ADVH from selling DR CHART(TM) in its entirety to another party (without the consent of the court) until the dispute between B&H and ADVH is resolved. This does not prevent ADVH from selling executable and fully operational software to other entities, ie. hospitals and medical provider groups. Anyone who deals with software knows, it is one thing to have a copyright, but it it much more effective to have the source code locked up in a couple of vaults.

A TRO is generally issued when one party claims "irrepairable harm" would occur if the action being restrained by the TRO were to occur. It is NOT a summary judgement of the likely outcome of the case. All IMHO and anyone who practices law in the State of New York is invited to correct me.

Looks like legal maneuvering on the part of B&O Law firm whose principal business is still shareholder class-action suits. I still think that this case was given by B&H to B&O to save money on discovery costs since B&O is already one of the "hounds in the hunt" for the shareholders suit. Remember that press release was by PRNewsire, who you have to pay to release news.

We shall see. I do think this press release will hurt the stock price a little tomorrow. It is not a surprise to any but the casual investor and I hope they are long gone by now.
