Larry B and Pallisards recent posts prompted me to listen to my recording of the August conference call again. During the call Lev was reminded that in the previous cc he had predicted volume production by September and whether they were on schedule. He responded he was optimistic about the Sept NI production date. He also said assembly equipment was being sent to South Korea in October and all the equipment had been tested but not in full bore operation.

The overall impression was things were running on schedule. Samples had been produced in Henderson on equivalent machinery and from the gist of the call samples were scheduled to be produced in NI in Sept..

I was left with the impression production was on schedule and to assume batteries were being produced in NI by the thousands was a realistic projection especially with the increase in personnel. Therefore FMK's projections are right on.

Larry B makes statements that if the above is true that SEC rules about material information may be in violation. What the heck does Larry B know about proper disclosure procedure. I'm sure Lev follows his legal advise in those regards.

<<According to SEC guidelines concerning the definition of material information, information is material if a typical investor would consider the information important in making a buy or sell decision. I can think of little that would be more material to my buy/sell decision for VLNC than whether their automated production line is producing 5 batteries per minute on a consistent basis.>>

Larry I doubt you are an expert on SEC regulations and to make reckless and stupid remarks is irresponsible. FMK's responses seem to be based on news releases and cc information along with his interpretation only.

Thank you FMK for your DD I am sure we will benefit from your interest and sharing of information!
