I made the call and we are still at square one ... as you are aware, Bonnie cannot locate the docket and must rely upon her memory ... he feels sure that there is a motion to dismiss that is active and has not been ruled on. Many other motions have been ruled on and were dismissed, but this motion to dismiss is probably (according to her memory) still active and has not been set for hearing or disposition. So, we are still not 100% sure of anything, except that the clerk (depending on her memory) is sure it has not been disposed, therefore is still active. In either case, it means nothing more than the fact that the original suit was filed and is still active. You know that, and you are just trying to put your spin on it ... bottom line, you are probably correct that it is still active.
