Just like it doesn't sit well with me it should not sit well in court provided , the court is made privy to.... However merely having a distaste , should such a ploy take place, is not material to this litigation. Thus a judge who strictly applies the law would not find that to be material.... Some companies announce buy back progams and and never buy a single share back... That said, if I were in ZAPs shoes I would diligently purchase and periodically post the number of shares accumulated or else suffer the rath of shareholders at the annual shareholders meeting and by their vote.... I certainly will exercise my vote.... The litigation will give us little if any. The attorneys will do well.... The company will be poorer and not trusted.... We could be wel under book for a loooooooooooooong time.. Sad situation...
