Rico: Please don't be such a single digit IQ. An active motion to dismiss is simply a motion that has been filed with the clerk of the respective court that has not been either heard by and/or acted on by the judge hearing the case. A motion also be withdrawn and then re-filed. A motion can be heard. A motion can be granted. A motion can be denied. At the very least this one looks like it has been filed and no action has been taken. God, you are so annoying. If you were my little brother I'd swat you with a rolled up newspaper and then give you a pink belly or an Indian rope burn..... When you sell stock, do you ask for the proceeds in quarters? Diver
