Well Joe, you are catching on here. Funny that the Baron and National Boston issued a clarification press release stating that they had received their approval from the FDA, don't you think? Especially when the EPA is the appropriate agency.

I am not purporting anything. It appears to be a fact under the EPA and FDA joint regulations and interpretations of the controlling laws that enable the agencies in the first place. That means that had NBMX actually applied to the FDA, they would have been sent to the EPA. Strange that they would have forgotten, if they had actually applied? Yet that's their clarification of their approval.

Here are a couple of existing products, competing products by the look of it. Notice which agency they are registered with.
