The market action of MSFT seems to indicate that either MSFT will win the litigation, or that if they lose it won't hurt them much. I don't know which one is dominating perceptions. Personally, I think it's likely that they will lose round 1, but win on appeal. My broker is well connected and he says the professionals think MSFT will win the initial trial. If this is the case, there may be a reaction when they lose. Perception is everything in the market, and though I agree with almost everything you say, a loss might cause some panic. My guess is that a win won't result in a big price jump if it is already anticipated, but who knows.
MSFT is the only one of the big cap gorillas I don't own now. I sold my shares very early in the recent decline to raise cash for other purchases near the bottom, which turned out to be a lucky move. At the right price I would maybe buy some back but I think the long term trend is to cheaper and more appliance like computers where MSFT has less gorilla advantages.
