Well, the court order was effective 5:05pm on Oct 2. The Press Release issued at 10:30am that morning Las Vegas time. So strictly speaking, I think they were just lucky.

What is more damning is when Michael Sylver spoke to the Las Vegas Sun reporter that wrote the October 22 news article:

At the same time, the company is orchestrating a "short squeeze" against investors who have sold the very same shares of stock short.

It would seem that from the posts about conversations with the Sun reporter that his interview may have occurred on or about or after October 6, 1998, as suddenly there was information from some Sun reporter being contacted by bashers. These posters that have the uncanny ability to get their noses pinched whenever Michael's sphincter contracts, began gleefully talking this topic of the Sun reporter up on October 7th and 8th. The article appeared two weeks later. About the right time delay from research to publication.

I wonder if the court would be interested in the testimony of the Sun reporter. While confidentiality of sources is protected, I don't believe this extends to protection in matters unrelated to its publication as to when conversations took place, especially since Sylver freely allowed himself to be identified and quoted in the piece.

Of course, the failure to retract the Press Release after the Order issued, indicates a lack of interest to correct the shift in responsibility occasioned by the Court Order.
