Hogger,

Even if shorting small company stocks or penny stocks were illegal in the USA, the act is perfectly legal in Canada, and to the best of my knowledge, Canada is where the alleged shorting is occurring.

Most of us don't engage in short selling any stock because of the inherent risks of massive losses as there is no limit (or ceiling) to loss as there is in just investing long. When investing long, the most you can lose is the amount of your investment (the stock goes to zero), but in short selling (especially a volatile penny stock) you can lose everything in a matter of a few minutes when the stock goes from pennies a share to a few dollars a share. Also, there is a prevalent attitude that shorting is un-American. It's sort of like rooting for the other guy to suffer losses so that you can gain. In reality, shorting provides a type of check-and-balance system for the stock market valuations. While I don't do it myself (because of the risk), at least I understand the principals behind it.
