The FTC seems like they are a stricter branch of the government than the FDA is..

First let's deal with omited address in #reply-6520305. The name and address of the recipient of that FDA warning letter which were:

Jay B. Weiss, President
Biogenetics Food Corporation
4475 Corporate Square Boulevard
Naples, Florida 33942*

So this time it wasn't AZNT.

Failure by a company to deal appropriately with a FDA warning letter can lead to very severe consequences. While the issue in the following instance wasn't potential health fraud in the marketing of a company's products, the following accounts of the troubles experienced by a NYSE company that got into difficulties with the FDA may be instructive:

somerset.nando.net
biz.yahoo.com

So while a FDA warning letter by itself may seem relatively innocuous, subsequent FDA enforcement actions can have real teeth to them. Bottom line: It's probably best for a company to steer clear of actions which will lead to enforcement actions from either the FTC or the FDA.
