Concerning to me is the timing of the AOL bid for Netscape Why during the MSFT DOJ trial ? Plus merging seems extreme . AOL could license any NSCP product and take a position like MSFT did with AAPL . SUN could do likewise . NSCP at $23 had recent insider selling so why buy it at $45 ? However a AOL stock swap for NSCP , enhanced by SUN's participation , could add synergy value to AOL , but MSFT benefits most of all . NSCP is MSFT's DOJ adversary which goes away with the AOL merger . SUN takes the DOJ stand this week and SUN's court decision last week against MSFT strenghtened the DOJ's case . NSCP is partnered with NOVL , another MSFT adversary , and NOVL is run by a former Sun VP . Sun would obtain these NOVL/NSCP products at a time when the DOJ is trying to prove MSFT a OS monopoly . AOL's initial investor's had and still have MSFT links . The combinations in this AOL/NSCP/SUN deal will undermine the DOJ's case . MSFT will cite this merger as contemporary evidence it is not a "OS" monopoly as JAVA is a worthy competitor. NOVL's CEO (former Sun VP) last year on JAVA : theregister.co.uk JAVA threatening Windows : techserver.com Of all the DOJ's witnesses so far the two left out of this deal is AAPL and IBM . Consequently , if the DOJ case is weakened by this , it might look favorably on AAPL seeking a strong merger partner as a further solution to the Window's monopoly . Regards, Jim K.
