I believe ViA holds a patent on their "hinge" since their computer is split into two halves that are hinged together. Personally, I regard that as an inferior design which perhaps had merit a generation or so ago when the physical size of a single-piece unit might have been an issue but which is no longer an issue with the MA IV (and even more so with its successors).

All I know about XYBR's patents is that their patent counsel (Jim Ralabate) is the same guy who handled Xerox's copier patents which gave them an early lock on the copier market. He and the rest of XYBR management seem very confident of their patent position, and their credentials suggest that they know a whole lot more about this subject than I ever will, so that's good enough for me. At the Comdex launch, Ralabate stated that XYBR has over 250 patents related to wearable computing in various stages of filing and issuance so it's clear they are covering their bases. I fully expect we'll be hearing more about patents and licensing in the weeks and months ahead.
