I am not sure. Patents can be licensed for differing applications to different entities. I think MVIS' position is good, though. Don't forget, they are talking about the scanner not just as a projector but also as a camera, and I have seen some comments elsewhere that suggest that it can both project an image onto an eyeball and sense the eyeball's motion at the same time, leading to all manner of super-trick interactive gizmos. The principle of eyeball-motion-based sensing is not new.

A detailed scrutiny of their website may shed some light on the exclusivity question, but I don't know.
