You're home free. Since records of their blunder are still in your account and they're acknowledging it was their mistake, probably a letter to the SEC and a confirmatory copy to ETrade will do remarkable things. They might be able to weasle out of it legally, but it's bad for business to let an error like this go uncorrected.

Just don't give up, maintain your sense of humor and stay reasonable. You'll get your money back.
