Hubert,
It might help to understand the legal reasoning for not taxing churches. Because the power to tax is the power to destroy, it has been deemed an attack on everybody's first amendment rights to freedom of religion to tax any religious organization. It is to protect everybody's rights equally to freedom of religion that the laws exempt churches. If religious organizations were taxed that would be the government interfering with the free exercise of religion which is a constitutional right (constitutional law) whereas the tax codes are only a lesser form of law and I can't think of the exact kind of law right now.
