Is it legal for Datek to execute my order before the market opens?

What happened was that I placed a limit sell at 31 13/16 on a stock the night before and it filled the next morning at that price at 9:15am EST. The stock actually opened at 32 and the low was 31 7/8. Am I justified in asking Datek for a 1/16th? If the stock had opened at 35, would I still have got 31 13/16??? Has this happened to anyone else?
