The motion in SDNY for reconsideration was denied. Now the question is whether E-data will be able to appeal now, or have to wait after a trial.

Should it seek a trial, no doubt many/all of the defendants could seek to be relased from the case by summary judgment. Most likely, they will win, since the businesses are not within the language of the patent as it has been interpreted.

Should it seek an appeal, there is no certaintly one would be heard now -- the appellate courts could decide it is premature.

I don't know why anyone should feel good about investing in E-Data. Even by a charitable reading of its patent, no one hear could claim that the patent actually contributed to society. No one who does online ordering got the idea from the patent, and there were instances of online ordering even before the patent was applied for.

And there's no reason to give the patent a charitable reading. It clearly contemplated going to a store or a kiosk, and walking away with a video tape / CD record, etc. that was made using copying it on demand onto a blank. Even if that idea were patentable, it is not what the defendants do.

E-data used to make money be selling fruit baskets. Maybe it still does. Anyone who buys the stock needs to pin there hopes on that.
