PCSS, I am sorry for your loss. I presume you are reasonably diversified and will live to fight another day.

However, I beg you not to follow a path that amounts to taking money from me and my wife and children. Please dont kid yourself into thinking that class action suits wont end up hurting innocent investors like me. Im sure the attorneys talk a good game about how improperly and fraudulently the management behaved (whether true or not), but they will always end up going to where the money is. You will not end up taking money from Gary or Martin W. or the board (I suspect you know this even though you might like to comfort your conscience...and the attorneys will help you....by naming them in the lawsuit). The attorneys will, in the course of time (about 30 seconds) realize that the only sensible path to helping all the poor victims (and themselves) is to settle with the company in such a way that management is off the hook (thats the only way management will settle anyway) and the COMPANY has to pay a big chunk of change to the attorneys. This money belongs to me and my family and other innocent owners. Most of my shares are actually in a modest trust fund for my kids. Please dont help take money from us because you took a loss. Perhaps it seems to far removed for you to see the inequity of this. (Im trying my best to not let you kid yourself...you know full well how class-actions play out).

I am not against holding management accountable if they have behaved illegally or unethically. What I am against is THE UNETHICAL PROCESS BY WHICH CLASS-ACTIONS ARE ULTIMATELY SETTLED. Its a disgusting, unethical wealth transfer. Its THEFT.

If you really feel youve been wronged (and who knows, someone in management or the board may have acted improperly), then go after only the bad guys and dont support class action attorneys that want the easy and all-too-predictable path...taking money from other shareholders.
