Judge Dismisses Barr Labs Antitrust Claim Vs DuPont Pharma

WILMINGTON, Del. (Dow Jones)--DuPont Co.'s (DD) Pharmaceuticals unit said a federal district judge
dismissed an antitrust claim filed by Barr Laboratories Inc. (BRL) related to DuPont's Coumadin
anticoagulant medication.

In a press release Tuesday, DuPont said the judge in a related pretrial ruling also dismissed three
consumer class-action suits that alleged DuPont monopolized the anticoagulant market with its
brand-name product.

Other unspecified Barr Laboratories claims weren't dismissed, DuPont said.

As reported, the companies have waged an ongoing legal battle over the anticoagulant market. DuPont
claims a generic version of its drug, which Barr Laboratories makes, can pose danger to some users.
DuPont has taken legislative steps to block the sale of generic Coumadin.

A Barr Laboratories spokeswoman said the judge's rulings are currently being reviewed.

Barr Laboratories develops, manufactures and markets generic and proprietary drugs.

DuPont Pharmaceuticals develops and delivers pharmaceutical products.

A Barr Laboratories spokeswoman called the judges' ruling a "great decision" because only one of the
company's antitrust claims against DuPont was dismissed. The spokeswoman said the "vast majority" of
its case against DuPont remains intact and will go forward.

Barr Laboratories also said it wasn't involved in the consumer class-action suits that were dismissed by
the judge.
