Firm Resume
August 1998

Our practice focuses on the preparation and trial of complex commercial cases. This includes contract, business tort, intellectual property, securities, antitrust, shareholder, employment, and class litigation, as well as litigation and strategic counseling in hostile business transactions.

Our lawyers have a wealth of trial experience representing both plaintiffs and defendants in what was often the most important litigation our clients had faced. For example, our lawyers were involved as trial counsel for the plaintiff in Pennzoil v. Texaco ($11 billion judgment and $3 billion settlement); Exxon v. Sohio (trial and related arbitration victory concerning gas pricing at Prudhoe Bay, Alaska); Texas Instruments v. Dell Computer (patent litigation resulting in successful licensing involving personal computers); Pennzoil v. Sharp ($25 million recovery in tax case); Texas Instruments v. Westinghouse (favorable settlement of contract litigation concerning secret "black world" defense related technology); Meadors v. General Motors (favorable settlement in side-saddle fuel tank case); and Toyota Town v. Gulf States Toyota (substantial verdict in franchise dispute).

We have been equally active in successfully representing defendants. We were involved as trial counsel in Continental Airlines v. American Airlines (no-liability jury verdict in $3 billion predatory pricing case); LISSA v. Lotus (no-liability verdict in $40 million breach of contract case); Service Corp. Int'l v. Loewen Group (successful defense of $4 billion hostile takeover bid); Time Warner v. Gaylord and CBS (favorable settlement of litigation over the new WB Television Network); Viacom v. Tele-Communications (favorable settlement in $6 billion monopolization case); Int'l Resource Ventures, Inc. v. Robert Friedland (favorable settlement for client Diamond Fields in C$4.3 billion suit for alleged theft of corporate opportunity).

While our lawyers have enjoyed great success in trial and contested litigation, we are equally proud of our record of resolving disputes quickly through negotiation and favorable settlement. We believe in full and detailed hands-on case preparation, but we realize that achieving our clients' objectives as quickly and economically as possible best serves their interests.

We understand that when lawyers have a stake in the outcome of a client's case it forges an identity of interest with the client important to winning. It also encourages earlier and more pragmatic analysis of cases and encourages a more efficient approach to resolving each matter. Accordingly, we devote a significant percent of our resources to litigating under fee agreements that tie our compensation to the results we achieve, for both plaintiffs and defendants.

Representative clients include American Airlines, Inc., BMC Software, Inc., Cooper Industries, Inc., Dynegy, Inc., Gaylord Entertainment Co., Houston Industries, Inc., Levi Strauss & Co., Raychem Corp., Schlumberger Ltd., Tele-Communications, Inc., and Zapata Corp.
