I agree that a good deal of latitude should be allowed, and that bringing suit isn't always the best response (and should never be the first response) to online criticism, even when mildly libelous. The courts have, for example, ruled that it's within one's rights to post comments like: "I think this company's a scam".

But clearly it goes too far to accuse, say, specific members of management of specific criminal acts, unless you're sure you can prove your allegations.

I don't characterize people as criminals, nor do I ever say that a company's a scam. Yes, MTEI turned out to be one in the real sense of the word. But I'd rather not be irresponsible in advance of incontrovertible proof. I "know" quite a lot that I'd never post without airtight documentation.

Part of the problem with Spidey and Rico is that they feel that the end justifies the means, and that they don't do independent research and don't attempt to verify what they're told. Another part of the problem is that they're just plain dumb.
