Okay, I'm going to touch on the subjects that I was asked to get answers on first and then give a little opinion and then tomorrow I will answer any questions that Bnezers might have.
1. The Aol lawsuit is moving right along.
A. Are 25 interrogatories that we submitted are due back from Aol in less than 12 days.
For those of you who don't know what we were allowed to ask about, probably the most important question that we get to ask is the following, in certain words, " Whether computer software created by AOL, " to perform the task of displaying articular information contained in the ComStock/Townsend database caused or allowed the erroneous reporting of BEW's stock information.
This has to do with republishing of information, or just copying it and posting it. The second most important issue coming up for BNEZ within the next 30 days is going to be the 4 depositions that we are allowed to conduct under the judgement. We are going to be able to call 4 employees of our choice from AOL and they must, by the court, go into the depositions. This is when, in my opinion, the dust is going to start flying. Now although Bnez hasn't made any announcements as to who they are going to depose, I have a pretty good idea and we will talk about that tomorrow night. But remember, I highly doubt that the company will put out a news release on this, we all know by now, that isn't the way BNEZ does business.
If and once the Aol lawsuit is settled or we go to court and lose then the company can begin to take the steps to become a reporting company. Remember, I know everybody wants us to become reporting, but until our lawyers, who we also pay with Bnez profits, says don;t say anything, the company isn't going to say anything. If anybody out there disagrees with me on this, we can talk about it over PM. But first make sure you sit down and get the lawsuit, read it and then be ready to spare over this issue. I have the phone number for the courthouse and the case number so anybody can get a copy of it.
Look at it this way, out lawyers have gotten us farther than any other company has in this type of a lawsuit, do you really think that Jack and Mikey are going to give out information that would cost Aol hundreds of thousands of dollars in lawyers fees for more pleadings to get, THINK NOT.
2. many people have asked about how we are going to get out PMA to the average Joe who doesn't go to the store and look for financial software. Alas, within the next week, I believe, or sooner or later, we have complete press packets going out to over ( this is a estimate ) 250 different publications, magazines, trade journals and independent reviewers. The packets contain PMA in the box, a write up on the company and the software. So I would hope to start seeing reviews on the software about 45 to 60 days from now, just when it will start hitting Staples shelves and other stores.
3. Bnez is still in talks with all the major retailers across the country, but everybody needs to remember, FOR EVERY STORE THAT SIGNS US UP AND PUTS US ON THEIR SHELF, WE ARE KNOCKING SOMEBODY ELSE OFF THE SHELF AND TAKING THEIR SPACE AND THEY ARE BEING MOVED OVER TO THE $9.99 and under rack. This takes time for people to decide. The one major factor on our side is that there isn't any software like ours out there, so stores are going to want to put it on the shelf next to windows on wallstreet and then people are more likely to buy one of the programs since there is something to compare each other to.
If you still haven't gone out and bought a copy of PMA, I really suggest you do, the packaging is incredible. I showed it to a guy on the airplane on the way back and he told me that he was " attracted to the packaging " and would pick it up and read the box to see what the software was.
Overall the company is moving right along, for people bitching, I can tell you this, NOBODY our size with our first product has ever moved this fast before, so don't bitch. Remember, evening knowing that our product might be in somebody's computer system, until Bnez receives the final paperwork on it, YOU KNOW WE WILL NOT ISSUE A PRESS RELEASE
I would expect the stock to stay where it is at until Jan 1st when the Aol lawsuit will really start to cook and then we will be less than 14 days from the product being on Staples shelves. Somebody else also mentioned that the shorters will start to cover after the first of the year and then won't have to pay as much or more time to pay capital gains tax.
So if your going to buy, these next 2 weeks are probably going to be the last chance to get it under .25 cents IMO
