As I've said, it doesn't always work. Spidey and his buddies seem quite incapable of understanding simple English. Their reaction to the following hilarious colloquy was that it wasn't "important", and of course that Bruce Judd, counsel for First Concorde, is the spawn of Satan.
(Note: Andy Mann owned, or at any rate managed, First Concorde. I'm not certain of the present status; I've been told he resigned all his positions there.)
To: Spider Valdez (11783 ) From: Janice Shell Sunday, Nov 15 1998 1:00PM ET Reply # of 11812 Oh nonsense. The "subsidiary" of what? Of a...well, far be it from me to characterize Titan/Total Concepts, lololol. THE COURT: Okay. Okay. And then I had as another 6 question did First Concorde transfer 200,000 shares of Back and 7 Neck to Titan Investments (phonetic) and Total Concepts 8 International (phonetic)? 9 And I'm not sure, and maybe you have made it very clear 10 someplace in the papers that you've presented to me, Counsel. 11 But who are Titan Investments and Total Concepts International, 12 and are they alternate business names for Amazon? Are they 13 related to Amazon? You can respond when the time comes. Now it gets REALLY good. This is perhaps my very favorite part of the whole transcript. I find myself wiping my eyes every time I read it. The above is from a colloquy between Judge George and Bruce Judd, the First Concorde attorney. The following is from Judd's cross-examination of Sylver: 20 Q. It's your testimony that Mr. Mann contacted you originally 21 for the first time about April 1998; is that correct? 22 A. I believe so. But I -- for you, I could check exactly when 23 he called from the phonebook because we have a log in all the 24 calls coming and going, and I can give you an exact.
25 Q. Then you engaged in a number of conversations over a period ASSOCIATED REPORTERS OF NEVADA (702) 382-8778 91 SYLVER - CROSS 1 of time regarding the acquisition of shares in Amazon; is that 2 true? 3 A. Regarding doing the private placement with -- Sherwood Cook 4 wrote the subscription agreement, yes. 5 Q. It took a number of conversations over a period of time 6 before you could direct your lawyer here in Las Vegas to create 7 documents; is that true? 8 A. No, no. You don't understand. Andy Mann would say he 9 wanted to do a 4,000,000-share private placement, and then I 10 would tell Sherwood Cook. And then Sherwood would draw up the 11 agreements, and then we'd fax them to Andy Mann. And he'd look 12 at it say, well, I've got to change this or change that. And 13 then we'd fax it back to Sherwood, and it went back and forth, 14 back and forth. 15 Q. So it took you three to four weeks doing this process of 16 conversations of sending documents back and forth for revision 17 before you came to your final agreement.
18 A. Yeah. In March and April of this year, yeah. I believe 19 so. 20 Q. Well, you first talked to him in April, right? That's what 21 you said over and over. 22 A. Well, it could have been. Like I said, it could have been. 23 It was back right after, you know, Christmas and the -- 24 after -- right after -- right at the beginning of the year, 25 February, March, April. That's right. But like I said, if you ASSOCIATED REPORTERS OF NEVADA (702) 382-8778 92 SYLVER - CROSS 1 want, we could call the office, and they could give the exact 2 date to you.
3 Q. we've been talking here you under oath telling the Court 4 that it was April. Now, are we talking about other months? 5 Are we talking two months earlier?
6 A. It could -I March, April. Yes, you're right.
7 Q. How about February?
8 A. No. I don't believe so. 9 Q. No way in the world it could be February? 10 THE COURT: He's answered, Counsel. He said I don't 11 believe so. 12 THE WITNESS: I don't -- I got to check it. 13 THE COURT: Let's move on. 14 THE WITNESS: But the phone bills could tell you 15 exactly if you need to know. I could tell you exactly the 16 phone bills.
17 BY MR. JUDD: 18 Q. Can this tell us where -- is that your signature?
19 A. Yeah. But this doesn't have to do with that. This is 20 opening an account. 21 Q. Right. You opened an account with First Concorde.
22 A. Right. 23 Q. Okay. So you didn't know Mr. Mann had anything to do with 24 First Concorde when you opened up your account. 25 A. Oh, yeah. I'm not -- I'm not even thinking about that. It ASSOCIATED REPORTERS OF NEVADA (702) 382-8778 93 SYLVER - CROSS 1 was talking about the subscription agreement. I completely 2 forgot about that altogether. 3 Q. Right. You opened up an account with Mr. Mann's company or 4 the company that he represented, First Concorde, right?
5 A. Right. 6 Q. You did that back in February. 7 A. Oh, okay. That's when it was. Okay. Incredible, no? I sit here openmouthed.
