Raymond: Motorola pursued this patent action in both Europe and Japan. I agree with your observation that the patent is very broad...it is exactly this breadth and lack of specificity that renders this particular piece of IPR vulnerable. Before we get too carried away here, I would again point out that this patent was filed in 1986, very early in Qualcomm's development of CDMA-type cellular system and was conceptually directed at the development of a Globalstar-type satellite system. This patent has NOTHING to do with Qualcomm's IPR position relative to W-CDMA. At last count, the company believes that at least one hundred of its patents would be infringed by Ericsson's proposed standard and that additional IPR may be involved...the clarity of the latter conclusion remains dependent on the proposed standard's final specifications, which have yet to be determined.
